What the measure does
Permits adults 21 years of age or older to possess and purchase up to three ounces of cannabis flower or an equivalent amount in other forms;
Allows adults to cultivate up to six mature cannabis plants after obtaining a noncommercial cultivation registration card (with no more than 12 mature cannabis plants per residence);
Directs the Dept. of Health and Senior Services to regulate and oversee the adult-use cannabis market, including the licensing of manufacturers, dispensaries, and microbusiness facilities;
Gives licensing priority to existing medical cannabis businesses;
Requires the department to promulgate regulations for the testing, packaging, and labeling of cannabis products to ensure product safety;
Provides localities the option of limiting or banning cannabis facilities within their jurisdiction if approved by voters in a local referendum;
Establishes a six percent retail tax on cannabis sales (in addition to normal state and local sales taxes); proceeds from this tax are directed to support veterans programs, legal services for low-income individuals, and other community non-profit services;
Directs courts in Missouri to issue and process expungements for misdemeanor marijuana offenses within six months of the effective date of the initiative; and
Amends Missouri’s existing medical cannabis law by:
Allowing nurse practitioners to recommend cannabis for patients;
Extending the expiration of a medical cannabis registration card from one to three years; and
Protects patients from loss of parental rights, employment discrimination, and “unduly burdensome” administrative penalties.
What the measure does not do
Permit the use of cannabis any place where the use of tobacco is prohibited;
Require employers to change their workplace drug use policies; or
Allow a single owner to control more than ten percent of the total number of dispensary or manufacturing licenses in the state.
