Kanawha County Teachers File Lawsuit Against Drug Testing Policy


Teachers say the the policy violates the constitution

CHARLESTON — A union representing Kanawha County teachers filed a lawsuit Wednesday morning.

The American Federation of Teachers says the new drug testing policy puts all teachers under suspicion and is legally wrong.

The suit seeks a declaratory judgment and injunction to prevent the implementation of the new policy.

"The problem is it is a direct violation of the constitution that says you have a right not to have your privacy be invaded," Rosemary Jenkins, AFT of WV, said.

The Kanawha County board of education voted in favor of the policy last month. It allows the district to randomly drug test teachers and other school employees.
