Medical marijuana bill on New Mexico House floor

Medical marijuana is on the move in New Mexico. So far, three medical marijuana bills have passed the Senate. S.B. 795—the Lynn Pierson Compassionate Use Act, sponsored by Sen. Cisco McSorley (D-Dist. 16)—and S.B. 891—the Medical Therapeutic Use of Pharmaceutical Grade Cannabis Act, sponsored by Sen. Steve Komadina (R-Dist. 9)—would allow qualified medical marijuana patients to use their medicine without fear of state-level criminal penalties. And S.B. 492—the Compassionate Use Medical Marijuana Act, sponsored by Sen. Shannon Robinson (D-Dist. 17)—would offer these protections to patients who use marijuana "by means of a topical patch, lotion, gel, alcohol or bath."

S.B. 891 and S.B. 492 are currently in the House Judiciary Committee. And S.B. 795 awaits a vote on the House floor. Given this momentum, there is no time like the present to urge your legislators to support medical marijuana. Please contact them now.

S.B. 795 and S.B. 891 do not contain "medical necessity" provisions—which allow patients to raise their medical use as a defense against court prosecution—and they don't allow qualified patients to grow their own medicine. But both bills do permit the use of medical marijuana for those who have their doctors' recommendations and registry ID cards, and the bills require the state to organize and set up a distribution system for marijuana.
