Judge Rejects Cathedral City Bid to Keep Pot Dispensary Close


RIVERSIDE, Calif. — A federal judge has declined to issue an injunction sought by Cathedral City to keep a medical marijuana dispensary closed.

At U.S. District Court in Riverside, Judge Stephen G. Larson said Monday he could find no federal precedent that would allow him to grant the city's wish to permanently close the shop, Essential Herbs and Oils.

The judge said the U.S. Justice Department would have to make such a request.

Marijuana use is illegal under federal law, which does not recognize the medical marijuana laws in California and 11 other states.

1 of the Cathedral City store's owners, Virginia Hurn, said she was unsure whether it would reopen. The shop has been closed since the city pulled its business license in February.
