Appeals Court Reverses Ruling in Marijuana Search Case
DES MOINES, Iowa (AP) — The Iowa Court of Appeals has reversed a ruling in a case where a police chief obtained a search warrant after talking to a woman who smelled of marijuana.
Lysa Fisk of Tama was charged with possession of a controlled substance after police searched her apartment and found several pipes and a box of pot.
Fisk claimed there wasn't probable cause for the search.
A district court granted her motion to suppress the evidence obtained as a result of the search warrant.
In today's ruling, the appeals court says there was cause and sent the case back to district court. |
