Delaware: Limited medical marijuana patient protections go into effect today

As you know, with your help, Delaware’s medical marijuana bill passed into law. Today, the law’s affirmative defense goes into effect.

If proven in court, the affirmative defense is intended to prevent qualifying patients who comply with the law from being convicted for medical marijuana possession. However, it does not prevent arrests or prosecutions. This affirmative defense will be available to patients from now until 75 days after ID card applications are available. The affirmative defense has not been tested in court, and there is no certainty, but MPP has created an info sheet for seriously ill patients with more information about how to assert an affirmative defense in court if arrested.

If you are a patient with a qualifying condition, you may wish to educate your doctor about the benefits of medical marijuana using this summary of studies. Patients who might need to assert the defense can ask their doctors to fill out this unofficial temporary certification form. Anyone who wishes to assert the defense must obey all rules listed in the law, which are summarized on the info sheet. We will keep you apprised of future developments.
