The Delaware Department of Health and Social Services has proposed regulations for the medical marijuana program and is currently taking public comment on the regulations through the end of April. MPP submitted comments on behalf of patients and potential providers in The First State. We very much encourage you to take the time to read the proposed regulations and submit your own comments. Feel free to use as much or as little of our document as you wish.

MPP is very disappointed the regulations do not include rules for compassion centers. Other jurisdictions, including Arizona, New Jersey, and D.C., are moving forward with dispensaries. Other than that major omission, for the most part, we are pleased with the proposed regulations. However, one egregious proposed regulation would allow the department to perform “on-site assessments” of patients and caregivers. A search based solely on an individual's patient or caregiver status violates civil liberties and flies in the face of the medical marijuana law.
