Connecticut: Hearing next Monday on proposed medical marijuana rules

Message: 

The Department of Consumer Protection has developed draft regulations for Connecticut’s medical marijuana program, and a public hearing is set for Monday, April 22. There are several provisions that need serious attention, and we submitted comments seeking improvement. Here are a few highlights:

* The regulations should do away with the $2 million escrow account. Banks might not be willing to have such accounts, and if required, the money should be available to the producer – not forfeited to the state.

* The draft regulations suggest the state will start with one producer statewide, and perhaps only one dispensary facility. The state should plan on more licenses to meet the needs of patients.

* The state should lower its producer license from $100,000 to allow small businesses to compete for state licenses.

* The state should provide options if no labs are available to test medical marijuana. 

* While the law itself provides for a pharmacist to oversee dispensary facilities, closely tying them to daily operations creates a burden on pharmacists who typically work at pharmacies licensed through the DEA.
