Colo.: DUID bill dies on House floor

SB 117 — the bill that would have declared anyone with five nanograms of THC per milliliter of their whole blood guilty of driving under the influence — has officially died. The Senate passed the bill, but the House failed to consider it before a legislative deadline tolled. The session ends today.
Although impaired driving is not to be tolerated, this bill was not the right way to address the problem. There is plenty of reason to believe that individuals who use marijuana more frequently than others — such as medical marijuana patients — would be considered impaired under the proposed per se law when they were actually sober. Colorado already criminalizes driving under the influence of drugs but requires prosecutors to prove impairment on a case-by-case basis based on the totality of the circumstances. This is a much more equitable policy.
