PUB LTE: Cannabis Initiative
February 26, 2004
San Francisco Chronicle
Editor—Your article on Oakland's cannabis initiative (Feb. 20) implies that it would violate state law by "legalizing all marijuana use for adults." In fact, our initiative does not "legalize" anything. Rather, it is a declaration of the voters calling for a taxed and regulated market "as soon as possible" under state (and federal) law.
In the meantime, respecting the constraints of law, the initiative would make private adult use of cannabis the lowest law-enforcement priority for city police. It specifically does not permit "all marijuana use for adults," excluding use in public streets, vehicles, etc. The initiative does not seek to violate the laws, but to fix them.
