Medical marijuana clean-up bill on governor's desk'act today

On Thursday, July 2, the California Assembly passed S.B. 1494 by a 41-34 vote. The bill, which would make many minor improvements to the state's medical marijuana law, is now on the desk of Gov. Arnold Schwarzenegger (R).

Among its other provisions, the bill would clarify that "a qualified patient, person with an identification card, or any designated primary caregiver may possess any amount of marijuana consistent with the medical needs of that qualified patient or person with an identification card." Under current law, this provision is not explicit and has led to some confusion between law enforcement and patients.

Also, the bill would assert that a person with a medical marijuana identification card or a designated primary caregiver could not be subject to arrest for possessing up to eight ounces or up to six mature or 12  immature plants, or any medically necessary amount (per a physician's recommendation).
