Calif.: Feds send clear message California needs better regulation

Message: 

Yesterday, the U.S. Department of Justice issued a game-changing memo to federal prosecutors around the country advising them that targeting individuals and businesses in strict compliance with well-regulated state marijuana programs should not be a federal law enforcement priority unless one of eight DOJ interests are involved.

The cornerstone of the memo is its emphasis on a robust regulatory system at the state level. Unfortunately, California’s medical marijuana law doesn’t include any licensing or regulatory framework for medical marijuana businesses. Federal officials in the state of Washington have already stated participants in their own poorly regulated medical marijuana program remain at risk of federal prosecution.

Please encourage your assembly member and senator to protect medical marijuana providers and the patients who depend on them by supporting a strong regulatory system for medical marijuana.

Earlier this year, Assemblymember Tom Ammiano introduced AB 473, which would have established a strong framework for dispensaries. After confusion during the Assembly vote, it failed to pass. Asm. Ammiano has vowed to continue working on similar legislation. In light of yesterday’s memo by the Department of Justice, this approach appears essential to protect California’s providers.
