Dear Mr. Walters:

This office is in receipt of a complaint wherein it alleges possible violations by yourself of Chapter 294A of the Nevada Revised Statutes (NRS). The Secretary of State, as the Chief Elections Officer for the State of Nevada is responsible for the enforcement of Title 24, Election Laws, of which Chapter 294A is a part. Specifically, the complaint alleges that you violated NRS 294A.150 and NRS 294A.220.

NRS 294A.150 and NRS 294A.220 speak to the reporting of contributions and expenses for every person or group of persons organized formally or informally who advocates the passage or defeat of a question or group of questions on the ballot at any election. The complaint alleges you were in the State of Nevada on a couple of occasions advocating the defeat of Question 9 on the statewide ballot, which was an Initiative relating to the use and possession of up to three ounces of marijuana.

Enclosed for your reference are the pertinent statutes and regulations as well as a copy of the complaint.

Please provide this office with a written response to the complaint by January 27, 2003.
