H.B. 4191: An Act to Amend the Standard for Determining the Presence of Marijuana in the Body While Operating Motor Vehicle


Currently, driving with any marijuana metabolites in one's system is considered driving under the influence in Michigan even though these can remain in a person's system weeks after they ingested marijuana. This bill would improve the statute; it would instead make it a crime to drive with five nanograms per milliliter of blood of two metabolites and THC in one's system. While this is a dramatic improvement over the current law, unfortunately, five nanograms/mL of blood of one of the metabolites (THC-COOH) can remain in a person's system for about 24 hours after they ingested marijuana.
