AK, AZ, CT, HI, ID, KY, MD, ME, MO, NC [7], ND [7], NE, NM, NV [7], OR, TN [7], VT, WA, WV, WY

[2] Law sunsets on October 1, 2007.

[3] Repealed 2002

[4] Applies to controlled substance violations while the individual is in actual control of a motor vehicle, e.g., possessing a baggie of marijuana while driving.

[5] Waived if person is to serve more than 1 year in prison.

[6] Not required, but available as part of an alternative to prison for drug felony (not simple pot possession).

[7] Most recent available data were from 1993.
